Fane Lozman Supreme Court Victory
WASHINGTON — About a decade ago, the leaders of a Florida city held a closed-door meeting to discuss how to intimidate and silence a critic named Fane Lozman. So far, their plan has not worked. Mr. Lozman calls himself “a persistent and tenacious underdog,” which may be an understatement. He is an indefatigable gadfly and an unusually successful litigant. In 2013, he won his first Supreme Court ca

Fane Lozman boat house US Supreme Court case
BY GLENN GARVIN | January 13, 2018 07:00 PM Perpetual South Florida political gadfly Fane Lozman has an odd effect on people. When he appeared before the U.S. Supreme Court five years ago, the justices were so intrigued by his arguments that his houseboat was a house and not a boat that they ended up arguing about whether the poor wooden puppet-boy Pinocchio was really a boat while he was travelin

The Supreme Court faces a test of the authority of politicians to use police to silence their critics. GARRETT EPPS  | JAN 15, 2018 If a citizen speaks at a public meeting and says something a politician doesn’t like, can the citizen be arrested, cuffed, and carted off to the hoosegow? Suppose that, during this fraught encounter, the citizen violates some law—even by accident, even one no one has

WASHINGTON – After a 12-year-long legal battle, the case of Riviera Beach resident Fane Lozman against the city was heard by the U.S. Supreme Court on Tuesday. Lozman was arrested at a city council meeting in 2006. He had only taken the podium for a few moments before then-City Council member Elizabeth Wade ordered him to stop talking and eventually asked an officer to “carry” Lozman out.

The Fane Lozman Story

Fane Lozman Activists - Supreme Court Case

This is a true story of a persistent and tenacious underdog who fought against the governmental seizure of 2200 homes and businesses in 2006 only to see that same government arrest and destroy his floating home three years later, for an alleged failure to pay one month’s rent at the marina. Fane Lozman did not give up but continued the improbable climb from a county court eviction case to the US Supreme Court.

The nomination for the Pete Weitzel/Friend of the First Amendment Award was based on Mr. Lozman’s most recent case before the US Supreme Court. Fane was arrested after speaking at a city commission meeting and is claiming that arrest violated his First Amendment rights. Mr. Lozman is a formidable citizen activist who has been engaged in sunshine issues for years.

They say the man who represents himself has a fool for a client, but this long-running David-and-Goliath case just might end with a local government looking like the fool.

It all started in 2006, when Lozman, a retired Chicago financier with plenty of money to burn on justice, claimed he had been illegally evicted from his floating home in Riviera Beach because of his activism against last-minute plans to sell the marina to a developer using eminent domain. He won that case, but the city stayed on his heels, coming after him with all kinds of accusations (he owed fees to the marina; his ten-pound dachshund was too dangerous).
